Barkhuizen Attorneys will act as an impartial third agent of any sale agreement made between parties pertaining to money, property or movable assets with a legally binding undertaking.
By means of using Barkhuizen Attorneys Escrow service which safeguards the buyer’s funds in a trust until the seller delivers what was promised in the agreement entered into between the buyer and the seller.
Hereby, also providing The Seller and Buyer with the peace of mind of the legitimacy of the entire sale process.
As the trade will only start when the buyer has deposited the agreed funds into the Escrow account.
Enabling the Seller to deliver the product / goods/ services /property or movable assets with full knowledge that the funds are available as per the agreement entered into.
Safeguarded by the undertaking that the Buyers funds will be released to the seller after delivery and inspection passed of such delivery with no disputes in the terms of the agreement entered into.
Safeguarding both parties.
1. Find the product, goods, services, property or movable assets you would like to purchase.
2. Inform the Seller that you will be using Barkhuizen Attorneys Escrow services for your transaction.
3. Register your transaction with Barkhuizen Attorneys.
4. Once an agreement has been reached between the parties, the Buyer will deposits the agreed funds via EFT into the Escrow account of Barkhuizen Attorneys which is an interest bearing account.
5. Barkhuizen Attorneys will notify all parties once the funds have been verified and cleared.
6. All parties will received a signed confirmation letter that the funds has been received and will be safeguarded in Escrow.
7. Barkhuizen Attorneys will send an email and sms to each party during each step of the transaction.
8. The seller will now deliver/ dispatch the product/ goods/ services to the Buyer.
9. There is a pre agreed time period to deliver and inspect the product/ goods/ service. If all the obligations was met by the Seller and the Buyer is in agreement, the funds will be released to the seller.
10. All interest earned on the Escrow account will be transferred to the buyer on completion of the transaction.
11. If the product/ goods/ service is not to the Buyers standard, the Buyer can renegotiate certain terms of the deal, request an extension to the delivery and inspection periods or lodge a dispute.
12. In the case of a dispute the funds shall remain safeguarded in Barkhuizen Attorneys Escrow account until the parties have reached an agreement or Barkhuizen Attorneys are ordered by a court of law what action should be taken.

1. Barkhuizen Attorneys has the capability to open a call account in the Buyers name at FNB. This means that the funds will be safeguarded in the name of the Buyer under Barkhuizen Attorneys’ control. The funds will only be released to the Seller once the contract condition has been fulfilled.
The Escrow transaction fee can be paid by either the Buyer or the Seller or split equally between the parties. Fees are calculated as a percentage of the transaction amount.

Barkhuizen Attorneys will stay an independent and impartial third party who has no interest in either party involved in the transaction. If a dispute between the two parties arises and cannot be resolved then we will direct the parties to arbitration and act on the written instructions of an independent arbitrator or court of law.

This service is to reduce the risk of any fraud in any transaction were money must change hands. Our Escrow service safeguards the Buyers funds in a trust until the Seller delivers what was promised in the agreement entered into between the Buyer and Seller. The Seller has peace of mind as the trade will only start when he Buyer has deposited the agreed funds into the Escrow account for the Seller to deliver knowing the funds are available as per the agreement made.

Funds may be transferred to Barkhuizen Attorneys via EFT (electronic funds transfer).

The length of the transaction all depends on the Buyer and the Seller, or all parties directly involved in the transaction. When goods/ products/ services has been delivered to the satisfaction of the Buyer funds will be transferred.

The minimum transaction Barkhuizen Attorneys will accept is R1000, but there is no maximum.
